Florida Chiropractor “Ask Koby” Shoots an Armed Man in His Office
Dr. Lenny Linardos, known to many on the west coast of Florida as the personal injury chiropractor behind the Ask Koby referral line, shot an armed man in his office on Monday in Holiday Florida.
Around 11 am Monday shots were fired at West Coast Spine and Injury Center according to the Pasco Sheriff’s department. Two 911 calls were made, one from a staff member at the Chiropractor’s office and the other from a nearby business.
Reports from local law enforcement and news sources describe Jaime Velez, 34, walking into Dr. Linardos’ business, proceeding into his office armed with a gun in his waistband and commencing a verbal confrontation with the Chiropractor. Dr. Lenny fired shots and Velez was transported to a local hospital with multiple gunshots to his abdomen. He is listed in serious, but stable condition.
As stories start to surface about the incident, pieces of what happened are falling together. Dr. Lenny Linardos told a pregnant patient that her boyfriend, Jamie Velez, was having an affair with one of his office employees. The relationship between Dr. Linardos and Jamie Velez has not been fully explained my either party. The day after the incident they were listed as friends on facebook, Dr. Linardos profile has since been removed.
A January 19th post by Jaime Velez on facebook pictures him with a very pregnant woman with the caption of "no more games, lies and deceit. Family first.
On Monday Morning, Dr. Linardos commented: "Haha, you just lied." These remarks have since been removed. Threats ensued from Mr. Velez following this action and the revelation to his girlfriend.
The Pasco County Sheriffs office questioned Dr. Lenny Linardos and released him Monday night. His attorney Cimos Angelis stated "Dr. Linardos is home. He cooperated fully with law enforcement," and "There was nothing that he did that was criminal. He defended himself."
enny Linardos, DC , a 2000 Life College of Chiropractic graduate, has practiced in Florida since 2003. Dr. Linardos created an accident referral hotline,1-877-Ask-Koby, in October 2004 featuring a voice over with a Jamaican accent telling people to call if they were involved in an accident. He has practiced at West Coast Spine and Injury in Holiday for the past 10 years.

Thursday March 21nd the Florida Insurance Commissioner office filed and was granted an appeal to stop a temporary injunction by a Florida State Appeals Judge in the ongoing recent Florida Personal Injury bill that went into effect Jan 1, 2013. The temporary injunction against the portion of the bill discrimination against providers issued by a Leon County judge Terry P. Lewis days earlier no longer stands.
The lawsuit over the PIP Bill was filed by attorneys Luke Lirot and Adam Levine on behalf of massage therapists and acupuncturists that were eliminated from the Florida No Fault Insurance and chiropractors that ad reimbursement severely limitied for treating car accident victims.
Currently the law is still in place, but late Thursday evening the attorneys Lirot and Levine filed an emergency motion to vacate the stay. They expect the motion will be on the Judge's desk by Monday.
The United Practitioners Organization Inc and the attorneys representing them in the case are asking for donations and affidavits on the impact of the new PIP law on your Chiropractic practice.

Leon County Circuit Judge Terry P. Lewis granted an injunction on the portion of the Florida Personal Injury Protection Bill that limited coverage to Chiropractors, Acupuncturists and Massage Therapists. The judge’s order puts a hold on the non-emergency benefits portion of the bill that limits treatment reimbursement of auto accident victims to $2,500, and excludes benefits for Massage and Acupuncture. His ruling was based on his opinion that 2012 PIP Bill (HB 119) violated the right of access to the courts found in the Florida Constitution.
Attorneys Luke Lirot and Adam S. Levine, MD JD filed a lawsuit for United Practitioners Organization Inc. on behalf of a group of Acupuncturists, Massage Therapists and Chiropractors against the Florida Office of Insurance Regulation. United Practitioners Organization Inc. funded the lawsuit through donations to their website since the PIP bill HB 119 passed last year. The group filed two prior suits over the discriminatory bill, both were dismissed.
Prior to the Florida no fault 2012 PIP bill changes, heavily lobbied by the Insurance industry and
Governor Rick Scott, Personal Injury Protection benefits in Florida include
$10,000 of medical coverage for car accident victims on their own car insurance policies. After the closed door, final hour legislative
dealings benefits were reduced to $2,500 unless an emergency medical condition
was declared by a MD, DO, DDS, PA or ARNP within 14 days of an auto accident.
Coverage of Massage Therapy and Acupuncture was completely excluded.
So
what does this Mean for Chiropractors, Acupuncturists and LMT's?
As long as the temporary injunction is in place, auto insurance companies are required to pay up to $10,000 for non-emergency conditions resulting from motor vehicle accidents, including Acupuncture and Massage Therapy. Unfortunately, a spokesperson for Florida’s Office of Insurance Regulation stated the office plans to file an appeal by Friday. An appeal could act as a hold on Judge Lewis’ court order. The appeal could be filed in First District Court of Appeal or directly to the Florida Supreme Court. Many questions have been raised and more answers should be available soon. Check back on CE Cruncher for more news about the impact of Florida PIP laws on Chiropractors as soon as it arises.
